1. Agreement to Terms

These Terms & Conditions constitute a legal agreement between you and Nereide ("we," "us," "our") regarding your use of our yacht charter services. By booking a charter or using our services, you agree to be bound by these terms.

If you do not agree with any part of these terms, you should not book our services. We reserve the right to refuse service to anyone for any lawful reason.

You must be at least 18 years old and have the legal capacity to enter into contracts to book our services. By booking, you represent that you meet these requirements.

2. Booking and Confirmation

2.1 Booking Process

Bookings can be made through our website, email, or phone. A booking is confirmed once you receive written confirmation from us and any required deposit has been received.

2.2 Deposit and Payment

We require the following payment schedule:

• Azure Morning Sail: Full payment due at booking
• Coastal Exploration Day: 50% deposit at booking, balance due 7 days before charter
• Island Riviera Voyage: 50% deposit at booking, balance due 14 days before departure

Accepted payment methods include bank transfer and major credit cards. All payments are processed in Thai Baht (THB).

2.3 Booking Modifications

Requests to modify confirmed bookings (dates, times, or experience type) are subject to availability and may incur administrative fees. We will make reasonable efforts to accommodate changes but cannot guarantee availability.

3. Cancellation Policy

3.1 Guest Cancellations

The following cancellation terms apply based on notice given before scheduled departure:

• More than 30 days: Full refund minus 10% administrative fee
• 15-30 days: 50% refund
• 7-14 days: 25% refund
• Less than 7 days: No refund

3.2 Weather Cancellations

If we determine that weather or sea conditions make safe operation impossible, we will offer either:

• Rescheduling to an alternative date at no additional charge
• Full refund of all payments made

Weather-related decisions are made by our captain based on safety considerations and are final.

3.3 Operational Cancellations

If we must cancel due to mechanical issues, crew unavailability, or other operational reasons, you will receive a full refund or the option to reschedule.

4. Charter Services

4.1 Service Description

Our charter experiences include the services described on our website and in your booking confirmation. We reserve the right to make reasonable adjustments to itineraries based on weather, sea conditions, or other factors affecting safety or guest comfort.

4.2 What's Included

Standard inclusions vary by experience type but typically include:

• Vessel charter with experienced crew
• Specified meals and refreshments
• Safety equipment and briefing
• Snorkeling equipment and water activities as described
• Insurance coverage as required by Thai maritime law

4.3 What's Not Included

• Transportation to and from the marina
• Alcoholic beverages (unless specifically included)
• Gratuities for crew (at your discretion)
• Personal travel insurance
• Any items not explicitly listed as included

4.4 Dietary Requirements

We accommodate dietary requirements and food allergies when informed at least 48 hours before departure. While we make every effort to meet special requests, we cannot guarantee complete allergen-free environments.

5. Guest Responsibilities

5.1 Safety Compliance

You agree to:

• Follow all safety instructions provided by our crew
• Wear provided safety equipment when required
• Inform us of any medical conditions that might affect your participation
• Not engage in behavior that endangers yourself or others
• Refrain from interfering with vessel operation or navigation

5.2 Conduct

Guests are expected to conduct themselves appropriately and respectfully toward crew, other guests, and the marine environment. We reserve the right to terminate a charter without refund if guest behavior poses safety risks or significantly disrupts the experience.

5.3 Prohibited Items and Activities

• Illegal substances or contraband
• Weapons of any kind
• Smoking in enclosed areas (designated smoking areas available)
• Fishing or collection of marine life without permission
• Use of drones without prior authorization

5.4 Damage and Loss

You are responsible for damage to the vessel or equipment caused by your negligence or misconduct. We may charge reasonable repair or replacement costs.

6. Liability and Insurance

6.1 Our Insurance

Our vessels carry insurance coverage as required by Thai maritime regulations, including third-party liability coverage. This coverage is subject to standard policy terms and exclusions.

6.2 Guest Insurance

We strongly recommend that you obtain comprehensive travel and medical insurance covering yacht charter activities. Our liability insurance does not cover your personal property, medical expenses, or trip cancellation costs.

6.3 Limitation of Liability

To the maximum extent permitted by law, our liability for any claims arising from or related to your charter is limited to the amount you paid for the charter. We are not liable for indirect, consequential, or punitive damages.

This limitation does not apply to:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under Thai law

6.4 Assumption of Risk

You acknowledge that yacht charter activities involve inherent risks, including but not limited to rough seas, changing weather, and marine hazards. You voluntarily assume these risks when participating in our experiences.

7. Intellectual Property

All content on our website and in our materials, including text, graphics, logos, and photographs, is owned by or licensed to Nereide and protected by copyright and trademark laws.

You may view and download materials for personal, non-commercial use only. You may not reproduce, distribute, or create derivative works without our written permission.

We may photograph or film during charters for promotional purposes. By booking, you consent to such photography and its use in our marketing materials. Please inform us if you prefer not to be photographed.

8. Privacy

Our collection and use of your personal information is governed by our Privacy Policy. By using our services, you consent to such collection and use.

9. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or other force majeure events. In such cases, we will make reasonable efforts to reschedule or provide refunds.

10. Governing Law and Disputes

10.1 Governing Law

These Terms & Conditions are governed by the laws of Thailand. Any disputes will be subject to the exclusive jurisdiction of the courts of Surat Thani Province, Thailand.

10.2 Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us to attempt informal resolution. Many concerns can be addressed through direct communication.

If informal resolution is unsuccessful, either party may pursue legal remedies in accordance with Thai law.

11. General Provisions

11.1 Entire Agreement

These Terms & Conditions, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and Nereide regarding your charter.

11.2 Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

11.3 Waiver

Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.

11.4 Assignment

You may not transfer your booking to another person without our written consent. We may assign our rights and obligations under these terms to another entity.

11.5 Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
